Goods means the articles or things described in the contract between The Company
and you, the Purchaser/Customer.
The Company includes any agents or subsidiaries of The Company.
2) These conditions shall be deemed to be incorporated in all contracts of The Company to sell printed materials and in the case of any inconsistency with any order or form of contract sent by the purchaser to The Company, whatever may be their respective dates, the provision of these Conditions shall prevail unless expressly varied in writing and signed by a director of The Company on behalf of The Company.
3) No order shall be binding on The Company unless and until it has been accepted and noted in a response e-mail (to the e-mail address the customer supplies at checkout) by The Company.
4) Dates for completion or delivery of goods shall be within the parameters stated on the website by The Company, any delay beyond those parameters, The Company will undertake to carry out additional work for the purchaser to the value of the print element of any goods not supplied on time. Such liability shall not extend to delays beyond the control of The Company including, without prejudice to the generality of the foregoing defects in files and non-performance of carriers.
5) By their nature, printed goods do not have a redeemable value and no refunds or credits for goods correctly supplied will be entertained.
6) a) All goods shall be paid for at the time of order.
b) No goods shall be dispatched or collection allowed until paid for in full.
c) All prices, including delivery, are shown exclusive of Value Added Tax and
this will be charged at the appropriate rate.
7) a) Any shortcomings or defects in goods supplied must be notified
to The Company within 2 working days of delivery. These goods must be returned
to The Company for inspection.
b) Nothing herein shall impose any liability upon The Company in respect of
any defect in the goods arising out of the acts, omissions, negligence or default
of the Purchaser, its servants or agents including without prejudice to the
generality of the foregoing handling and storage of the goods. All proofing
and copyright clearances are the sole liability of the Customer at the time
of file supply.
c) Nothing herein shall have the effect of excluding or restricting the liability
of The Company:
i.) For death or personal injury resulting from its negligence insofar as the
same is prohibited by U.K. statute, or;
ii.) Under sections 12,13,14 and 15 of the Sale of Goods Act 1979 to a purchaser
who is dealing with a customer (as defined by section 12 of the Unfair Contract
Terms Act 1977).
8) All artwork files must be uploaded to us in the PDF file format as specified in the artwork supply guide page. You, the Customer, are solely and entirely responsible for proofing all artwork before upload to The Company. We do not provide any pre-flight proof check before going to print. Any errors or poor qualities within the content of the printed materials you supply are the Customer's sole liability and not in any way the liability of The Company. No refunds/reprints will be made available for any content errors, qualities or omissions of any kind after upload.
9) Upon sight of artwork, and at its sole discretion, The Company reserve the right to decline to print any item it deems to be inappropriate. Any payments made for work rejected by reason of this clause will be refunded in full.
10) It is the Customer's sole responsibility to ensure any and all images, text or references used within the content of the supplied artwork is legally the Customer's copyright or has been legally purchased by the Customer, or is free of all copyright to use on the Customer's printed material. It is agreed by the Customer that any printed material supplied by the Customer and subsequently printed by The Company which contains any Copyrighted images, text or references that are not legally owned, cleared for use or paid for use by the Customer prior to upload will, in the case of any Copyright usage legal issues arising, be the sole liability of the Customer and not in any way the liability of The Company, whether direct or by association.
11) All products are priced on an individual basis. This means each product purchased is of a value that changes with quantity only and, for example, in the case of Business Cards, one order of cards cannot have 2 separate names (i.e. order 500 and have 250 of "J. Smith" and 250 of J. Jones" - each name would have to be a separate order of 250.) The same principle applies to flyers/leaflets and stationery. Any 2 sets of artwork received for the same individual order will not be printed until the error is addressed and The company will send an e-mail advising the customer as such.
12) The Company shall not be liable for any costs, claims or damage arising out of any act of tort or omission or breach of contract or statutory duty calculated by reference to profits, income production or accruals or loss of such profits, income production or accruals or by reference to accrual of such, claim, damages or expenses on a time basis.
13) The liability of The Company to the purchaser for any loss or damage of whatsoever nature and howsoever caused shall be limited to and in no circumstances exceed the price of the goods.
14) If the purchaser shall be in breach of any of their obligations under the contract, The Company may (without prejudice to The Company’s rights subsequently to determine the contract for the same cause should it so decide) suspend further deliveries of goods without notice until any defaults by the purchaser are remedied.
15) No statement, description, information, warranty or recommendation contained in any catalogue, price list, advertisement or communication or made verbally by any of the agents or employees of The Company shall be construed to enlarge, vary or override in any way these conditions.
16) Any concessions made or latitude allowed by The Company to the purchaser shall not affect the strict rights of The Company under the contract. If in any particular case any of these conditions shall be held to be invalid or shall not apply to the contract the other conditions shall continue in full force and effect.
17) The contract shall in all respects be governed by English law and shall be deemed to have been made in England and the purchaser and The Company agree to submit to nonexclusive jurisdiction of the English courts.
18) The Company reserve the right to alter prices without notice as and when necessary due to the costing involved for Paper Prices which can incur possible cost increases beyond our control. Price changes will be reflected on the website immediately at checkout stage and as soon as possible on the front pages and order pages.
